Pregnancy

If you are/become pregnant during the term of your contract, you have certain rights and obligations. There are also certain obligations that apply should you become sick during your pregnancy.

Your obligations

If you are pregnant you must present a certificate of pregnancy to JobService. You can obtain this from your midwife. You should notify the UWV yourself once you have given birth.
You are expected to cooperate fully with any requests or questions from the UWV during your maternity leave.

Your rights

You are entitled to a minimum of 16 weeks maternity leave. The maternity leave can commence from six to four weeks before your due date.
JobService will apply for your maternity pay from the UWV on your behalf. The maternity pay is equal to 100% of the maximum daily wage.

Parental leave

If you want to take parental leave after your maternity leave, rules apply as specified in the Collective Labour Agreement: HBO CAO. This means among other things that you must have been employed at Jobservice for at least one year to be entitled to parental leave.

Partner/paternity leave (based on the law: wet WIEG)

If your partner gives birth you have a right to partner/paternity leave. In short:

  1. Leave on the day(s) your partner gives birth;
  2. One week leave in the weeks after the birth;
  3. Five weeks of additional leave in the first six months after the birth.

Off sick during pregnancy?

If you are off sick before your maternity leave, then you must commence your maternity leave six weeks before your due date. You must notify JobService of the date on which your maternity leave commences.

If you are off sick during or after your pregnancy, you are entitled to sick pay from the first day of your incapacity for work. JobService will report this to the UWV. It is important that you report sick promptly. Failure to do so may result in your sick pay being temporarily refused.

You must inform JobService when you return to work after sick leave or maternity leave.
